Human Rights (Seminar)

Inhalt: This course provides an introduction and overview of international human rights law. The course is divided into three parts. In the first part, History and Theory, we will consider the historical development of the concept of human rights, from the idea of constitutional protections for fundamental rights to the current international framework of human rights treaties, and briefly view the main theoretical approaches to human rights. In the second part, Human Rights Law Institutions, we will consider in order: 1. The international level, mostly United Nations institutions and instruments, so charter bodies and treaty bodies. 2. A case study on the international level of protection, the recent report of the UN Human Rights Council on the situation in Myanmar. 3. The regional level, so all regional human rights treaties and institutions. 4. The first case study for the regional law consists in a review of the European human rights framework, including the Council of Europe, the European Convention of Human Rights and the European Court of Human Rights. 5. The second case study will consist in an overview of the role of human rights in the European Union, and specifically the Charter of Fundamental Rights. The third part, human rights in context, will be divided into three lessons: 1. Human rights in international economic law. Human rights law exists within general international law and can enter into relation, or conflict, with other areas of international law. Given the general scope of the PELP degree, which includes economics, we will consider specifically the role of human rights in the regime of trade and investment law. 2. The protection against torture. 3. Freedom of speech and its limitations.
