Law and the Anthropocene (Seminar)

Inhalt: This course investigates the place and role of law in the Anthropocene epoch. The Anthropocene is the proposed new geological epoch where humans are seen to exercise geological powers that are changing the functioning, stability and resilience of the Earth system. Law, generally speaking, is created to govern human behaviour, while specialized legal fields such as environmental law govern how humans engage with the environment. Scientific evidence suggests that the Anthropocene’s socio-ecological crisis is deepening. This realisation prompts several questions: Has law managed to effectively govern human behaviour in relation to the environment? If not, where has law failed and possibly even been complicit in reinforcing the conditions that create the Anthropocene? How could law be reformed to enable humans and non-humans to lives just lives of dignity in ways that also respect planetary integrity? How could alternative paradigms such as degrowth, rights of nature and indigenous epistemologies be used to guide a re-imagination of law for the purpose of living well in the Anthropocene? The objective of this course is to broadly reflect on these and related questions.
