Inhalt: This course provides an introduction to law & economics. It is primarily based on a method of case analysis. Nearly all cases are published in Barnes, D.W./Stout, L.A. (1992), Cases and Materials on Law and Economics, St. Paul (West Publishing) (B/S 1992). Relevant cases are also provided in the material folder, groups 1 to 11. All participants must choose one group to enrol. All groups are required to analyze a number of cases that illustrate the methods and functions of an economic analysis of the law. These cases must be presented in front of the class. The notes and questions (in Barnes/Stout) are a part of the case materials and may help to introduce the audience to the relevant law and economics arguments. Presentations must be uploaded to the material folder (Presentations) each Friday preceding the seminar, at 12.00 pm (noon). For example, group presentation 1 for April 1 must be made available to the class until Friday, March 29, 12.00 pm (noon) the latest. Participants can enrol in groups of two or three presenters. The endterm test will be held during the last session (1 July).

Inhalt: In diesem Seminar sollen die öffentlichen Diskurse und Debatten über Ängste unter demokratischen Bedingungen nachvollzogen werden. Im Mittelpunkt steht dabei die Bundesrepublik Deutschland, die mit Frank Biess als eine „Republik der Angst“ verstanden werden soll. Angelehnt an das Buch von Biess diskutieren wir die maßgeblichen deutschen Ängste von der Zeit der Besatzung bis zur Migrationskrise.

Der wissenschaftliche Blick auf die Welt. Objektivität und Subjektivität in der Forschung (Profil DeKri, Modul 2) (Seminar)

Inhalt: Ein zentraler und zugleich umstrittener Begriff der neuzeitlichen Wissenschaft ist die Objektivität. Leitend ist deshalb die Frage, wie sich das Ideal der wissenschaftlichen Objektivität historisch herausgebildet hat und wie sich Objektivität und Subjektivität zueinander verhalten. Wie werden in der Wissenschaft Erkenntnisse produziert, gedeutet und eingeordnet? Wann und wie werden persönliche Meinungen eingebracht? Wie wichtig ist es zu werten und zu urteilen? Welche Rolle spielt die Standardisierung von Methoden? In welchem Verhältnis stehen die Geistes- und Naturwissenschaften? Ausgehend von wissenschaftshistorischen und wissenschaftstheoretischen Perspektiven entwirft das Seminar ein möglichst breites Panorama zur wissenschaftlichen Objektivität, die angesichts aktueller Entwicklungen erneut Relevanz erhält. Vor diesem Hintergrund kann nicht zuletzt gefragt werden: Wie wird in der Wissenschaft diskutiert und debattiert? Welche Möglichkeiten und Grenzen bestehen hier? Zusätzlich sieht das Seminar eine Exkursion vor.

Inhalt: The survey module introduces students to three aspects of North American Studies: first, NAS as an academic subject influenced by academic as well as non-academic discourses (such as politics, religion, and history); second, NAS encompassing a vast range of topics, such as minority voices, aspects of “Otherness”; and third, NAS as a showcase for cultural production reflected in literature, art, and film.

Konfliktmanagement und Mediationsverfahren vor dem Hintergrund des Vio/Coca Cola Grundwasserkonflikts (Seminar)

Inhalt: Während die Dürren der vergangen Sommer in Niedersachsen im Bewusstsein einer für Klimafolgen und Pegelstände sensibilisierten Bevölkerung noch nachwirken, beantragt der Coca-Cola Konzern die Bohrung eines dritten Brunnens im Landkreis Lüneburg. Künftig möchte Coca-Cola in Reppenstedt 350 Millionen Liter Grundwasser pro Jahr für die Mineralwasser und Bio-Limonaden Marke ViO entnehmen. Damit würde der Coca-Cola Konzern seine Wasserentnahme im Landkreis verdoppeln. Für Kritiker lassen sich Geschäftsmodell und Image des Unternehmens kaum mit dem Selbstverständnis der Region vereinbaren - einer Region die auf Nachhaltigkeit setzt und Vorreiter im Bereich Umweltschutz sein möchte. Mit einem im Februar 2021 gestarteten Pumpversuch möchte der Konzern die Auswirkungen der Wasserentnahme auf den Grundwasserspiegel und umliegende Ökosysteme überprüfen und eine Unbedenklichkeit des Vorhabens nachweisen. Aus Sicht von Coca-Cola und der zuständigen Unteren Wasserbehörde des Landkreises Lüneburg handelt es sich dabei um einen Teil des gängigen Genehmigungsverfahrens, bei dem sich konsequent an alle Regeln gehalten werde. Kritiker aus der Bevölkerung bemängeln jedoch, dass hier fern von jeglicher Zustimmung vorab Tatsachen geschaffen werden. Eine Onlinepetition gegen das Vorhaben wurde bereits von über 120.000 Personen unterschrieben, eine Bürgerinitiative hat sich formiert und organisiert friedlichen Protest. Eine Sabotage des Brunnens die von beiden Seiten verurteilt wurde macht deutlich, dass viele Gemüter dennoch erhitzt sind. Wasser ist ein Allgemeingut, doch es stellt sich die Frage ob die gesetzlichen Regelungen zur Verteilung von Nutzungsgenehmigungen ausreichen, um die Wasserwirtschaft im 21. Jahrhundert zukunftsfähig zu organisieren. Kann ein Dialog zwischen den Konfliktparteien hier noch zu Lösungen beitragen?

Kritische Entwicklungsökonomie. vom Kolonialismus zur Nachhaltigen Entwicklung (Seminar)

Inhalt: Die Veranstaltung führt in Theorien und Konzepte der Entwicklungsökonomie ein, und diskutiert Kontroversen und Konflikte rund um "Entwicklung" aus Sicht der kritischen Internationalen Politischen Ökonomie, Postkolonialen Studien sowie der Politischen Ökologie. Das Seminar ist in vier Blockveranstaltungen unterteilt. Zunächst befassen wir uns mit historischen Perspektiven die den Zusammenhang von Ökonomie und Kolonialität ausloten, etwa am Beispiel des trikontinentalen Sklavenhandels und der Ökonomisierung von Leiblichkeit. Im zweiten Block lernen die Studierenden mehr über die Ideen- und Institutionengeschichte internationaler Entwicklung. Der dritte Block behandelt unterschiedliche politische und ökonomische Aspekte der nachhaltigen Entwicklungsziele (SDGs) der Vereinten Nationen, etwa zu Themen wie Grüne Ökonomie, finanzielle Inklusion und Care-Ökonomie. In der abschließenden Sitzung stellen Studierende ihre eigenen Forschungsvorhaben im Feld der kritischen Ökonomie zur Diskussion.

Los Derechos de los Pueblos Indígenas de América Latina en el Sistema de las Naciones Unidas en tiempos del COVID-19 (FSL) (Seminar)

Inhalt: El presente seminario transdisciplinario tiene el objetivo de introducir la problemática de la situación de los Pueblos Indígenas (PPII)de América Latina – especialmente la de las mujeres indígenas - desde la así llamada conquista hasta la actualidad desde un punto de vista socioeconómico, jurídico, antropológico y ético. Por lo tanto, se dedicarán las/los estudiantes a estudiar la diversidad de realidades y filosofías de vida indígena, analizarán y discutirán diferentes enfoques y discursos académicos sociopolíticos correspondientes, como ser, el concepto del buen (con)vivir, las teorías del indigenismo y la del indianismo, del constructivismo social, de la decolonialidad, del extractivismo progresista, la teoría de la interseccionalidad, etc. En el seminario se presentarán y debatirán diferentes problemas normativos en el ámbito de instrumentos y políticas nacionales e internacionales con respecto a los Pueblos Indígenas. El organismo de las Naciones Unidas (ONU) llamado “Mecanismo de expertos sobre los derechos de los pueblos indígenas, (MEDPI)”servirá como ejemplo para analizar la problemática de la situación legal y jurídica de los PueblosIndígenas en el sistema de las Naciones Unidas. Las/los participantes del seminario tendrán la oportunidad de esbozar planteamientos propios para los diferentes puntos de la agenda de la próxima sesión del MEDPI que se llevará a cabo del 12 al 16 de Julio en Ginebra si la pandemia lo permite.

Inhalt: New Work – Einführung in die New Work und Konsequenzen für Selbstmanagement und Personalführung Entwicklungen und aktuelle Ausprägungen des New Work werden aufgezeigt und anhand von Schlüsseltexten aus verschiedenen Wissenschaftsdisziplinen kritisch-konstruktiv diskutiert und reflektiert. Darauf aufbauend werden die Chancen und auch möglichen Risiken und Hindernisse, die die Entwicklungen im Bereich des New Work für jeden Einzelnen, für Organisationen und auch für Gesellschaften eröffnen, reflektiert. Zugleich wird aufgezeigt, welche Herausforderungen für die die Führung von Menschen damit verbunden sind. Flexibilität und perspektivische Vielfalt im Denken und Handeln sowie die Bereitschaft zu Reflexion und Selbstentwicklung sind dabei unverzichtbare Kernkompetenzen. Veränderung und Entwicklung bedingen einander. Die Entfaltung individueller Potenziale ist entscheidend für die Bewältigung dieser Prozesse. Wenn wir Umbrüche und Veränderungsnotwendigkeiten als Chance für Selbstentwicklung und inneres Wachstum annehmen, können wir Veränderung selbstwirksam für uns gestalten.

Risk and Sustainability (FSL) (Vorlesung)

Inhalt: The lecture gives an introduction to risk research and the relation of the concept of risk to the normative goal of sustainability. After an introduction to the basic definitions and terminology, students will obtain an overview over the quantitative methods of risk theory. The following main part of the course looks at different manifestations of risk that are relevant in the sustainability context, and that can be subsumed under the terms ‚catastrophic/existential risk‘ – one example being climate change – and ‚extreme events‘, which are low-probability events with potentially severe impact on humans and nature – one example being asteroid impacts. Further focus will be given to the psychology of risk and how it affects and hampers pro-environmental political and individual decision making. Morever, there will be a short introduction to the field of risk ethics.

Inhalt: Optional language: Spanish. The complexities of modern life can be challenging to navigate. Systems thinking is a tool to conceptualize and approach those complexities without separating them from their environment. By learning to think in open instead of closed systems, students will start to recognize all the implicit actors and connections within their context. Visualization techniques will be practiced in the seminar in order to gain a broader understanding of a given subject. A mechanistic, reductionist worldview can only be balanced by a systemic worldview of networks, interrelations and communication, allowing us to see qualities that may lead to innovation in social and industrial systems.

TASS - Transatlantic Sustainability Seminar (FSL) (Seminar)

Inhalt: Due to the Corona-crisis, the original program had to be changed. It is neither possible to meet at the university (part 1) nor to take part in the summerschool 2020 (part 2), nor is it possible to travel to Texas for the 2-week excursion (part 3). For 2020, the Texas side has cancelled every program abroad. You can see what was originally planned further down in this text. Instead, I will try to go along with the original idea by offering a similar online-program. I therefore suggest: 1. to meet online (preferably via ZOOM) at the scheduled times; I will provide you with material and tasks 2. you prepare presentations plus an essay on selected topics of German and European /American challenges regarding sustainability; the topics can also include the current Corona-crisis; if possible, you prepare the presentations and essays together with American students (I have asked the Texas side for such cooperation) 3. the presentations are given online in a ZOOM-conference, if possible together with the US-students. The original program was: Part 1: The seminar starts with students working on the different themes and preparing a joint presentation within the spring semester 2020. One or two students from Leuphana prepare a topic together with one or two students from Texas A &M/Kingsville. As mentioned above, the topic should come from the area of energy and should give insight in either legal, economic, social, technical or cultural problems of the exploitation and the use of energy. A topic can be, for instance, the impacts on the environment, especially on ground water, deriving from Fracking. Part 2: The Leuphana students take part in the Leuphana summer school for American students in the second half of May, 2020. This program has been offered since the beginning of the 90ies, teaching American students international aspects combined with intercultural issues in an international environment in order to prepare young adults for a job in a globalized world. It comprises hard facts from fields such as economics, legal, or management, but also soft skills like intercultural communication or business negotiations. By accompanying and maybe even hosting American students, Leuphana students will learn about their background and get ideas for their presentations. Part 3: The Leuphana students will present their results at the Texas A&M-summer seminar in August 2020 in Texas. The course will last for all in all two weeks. Accommodation will be provided by the American side as well as a cultural program. The program will also include excursions, for example to the Eagle Ford Shale fracking site in South Texas. Students will have to cover their expenses, mainly consisting of travel costs and the necessary spending on food etc.
