An Introduction to Law & Economics (FSL) (Modul 3, Profil GRecht) (Seminar)

Inhalt: This course provides an introduction to law & economics. It is primarily based on a method of case analysis. Nearly all cases are published in Barnes, D.W./Stout, L.A. (1992), Cases and Materials on Law and Economics, St. Paul (West Publishing) (B/S 1992). Relevant cases are also provided in the material folder, groups 1 to 11. All participants must choose one group to enrol (see group function of MyStudy). All groups are required to analyze a number of cases that illustrate the methods and functions of an economic analysis of the law. These cases must be presented in front of the class. The notes and questions (in Barnes/Stout) are a part of the case materials and may help to introduce the audience to the relevant law and economics arguments. Presentations must be uploaded to the material folder (Presentations) each Friday preceding the seminar, at 12.00 pm (noon). For example, group presentation 1 for April 4 must be made available to the class until Friday, April 1 , 12.00 pm (noon) the latest. Participants can enrol in groups of two or three presenters. The endterm test will be held during the last session (4 July).

Ecology without Nature and Anthropocene without Anthropos (FSL) (Seminar)

Inhalt: Faced with the current ecological crisis, climate change, global pandemics, loss of biodiversity and ecosystems – all phenomena that have been shown to be inextricably linked to social, political and economic crises –, the dualism with which the modern West has shaped the world, namely the dualism nature/culture – and hence Nature/Human – collapses, materially and conceptually. Human and Nature, with a capital letter, in the sense of a-historical universal categories are unserviceable, as well as harmful and must be deconstructed. However, it is precisely at this juncture that the concept of the Anthropocene emerges, which – at least in its mainstream narratives – reintroduces the human as the abstract universal agent of environmental change and subjects of a new geological era. In the face of these narratives, the course tries to articulate an operation of de/construction to lead to the paradoxical but extremely valuable outcome of thinking an ecology without Nature – to take up Timothy Morton’s expression – and the Anthropocene without Anthropos. In doing so, we will trace an interdisciplinary route, taking into consideration contribution to the debate coming from sociology, anthropology, ecofeminism, postcolonial studies and critical animal studies.

Inhalt: In der Psychologie des Urteilens und Entscheidens wird erforscht, wie Menschen Entscheidungen treffen und wie sie Risiken wie den Klimawandel, Verschmutzung, umweltbedingte Gesundheitsrisiken, oder Naturkatastrophen wahrnehmen. Dabei integriert sie Theorien und empirische Erkenntnisse aus unterschiedlichen Disziplinen wie der Ökonomie, der Biologie und auch den Computerwissenschaften. Nach einer Einführung in die Geschichte der (Umwelt)psychologie werden zwei Fragen beleuchtet: 1) Wie nehmen Menschen verschiedene Umweltrisiken wahr und wie können diese verständlich kommuniziert werden? Sowie 2) Was wissen wir über die Faktoren, die unterschiedliche Entscheidungen voraussagen? Die in dieser Vorlesung vorgestellten Antworten auf diese beide Fragen umfassen zum einen, wie Risikowahrnehmung und Verhalten sich sowohl durch Unterschiede in etwa Werten, politischen Einstellungen, oder individuellen Lernerfahrungen erklären lassen. Sie umfassen zum anderen, wie der Kontext, wie etwa Grundeinstellungen, das Verhalten anderer, Infrastruktur oder Informationen aus den Medien bestimmte Verhaltensweisen beeinflusst. Ziel ist zu verstehen, wie im politischen, ökonomischen und sozialen Wandel hin zu mehr Nachhaltigkeit Einzelne mitgenommen und wie sie kompetenter mit den Herausforderungen dieses Wandels umgehen können.

Inhalt: In diesem Seminar sollen die öffentlichen Diskurse und Debatten über Ängste unter demokratischen Bedingungen nachvollzogen werden. Im Mittelpunkt steht dabei die Bundesrepublik Deutschland, die mit Frank Biess als eine „Republik der Angst“ verstanden werden soll. Angelehnt an das Buch von Biess diskutieren wir die maßgeblichen deutschen Ängste von der Zeit der Besatzung bis zur Migrationskrise.

Konfliktmanagement und Mediationsverfahren vor dem Hintergrund des Vio/Coca Cola Grundwasserkonflikts (Seminar)

Inhalt: Während die Dürren der vergangen Sommer in Niedersachsen im Bewusstsein einer für Klimafolgen und Pegelstände sensibilisierten Bevölkerung noch nachwirken, beantragt der Coca-Cola Konzern die Bohrung eines dritten Brunnens im Landkreis Lüneburg. Künftig möchte Coca-Cola in Reppenstedt 350 Millionen Liter Grundwasser pro Jahr für die Mineralwasser und Bio-Limonaden Marke ViO entnehmen. Damit würde der Coca-Cola Konzern seine Wasserentnahme im Landkreis verdoppeln. Für Kritiker lassen sich Geschäftsmodell und Image des Unternehmens kaum mit dem Selbstverständnis der Region vereinbaren - einer Region die auf Nachhaltigkeit setzt und Vorreiter im Bereich Umweltschutz sein möchte. Mit einem im Februar 2021 gestarteten Pumpversuch möchte der Konzern die Auswirkungen der Wasserentnahme auf den Grundwasserspiegel und umliegende Ökosysteme überprüfen und eine Unbedenklichkeit des Vorhabens nachweisen. Aus Sicht von Coca-Cola und der zuständigen Unteren Wasserbehörde des Landkreises Lüneburg handelt es sich dabei um einen Teil des gängigen Genehmigungsverfahrens, bei dem sich konsequent an alle Regeln gehalten werde. Kritiker aus der Bevölkerung bemängeln jedoch, dass hier fern von jeglicher Zustimmung vorab Tatsachen geschaffen werden. Eine Onlinepetition gegen das Vorhaben wurde bereits von über 120.000 Personen unterschrieben, eine Bürgerinitiative hat sich formiert und organisiert friedlichen Protest. Eine Sabotage des Brunnens die von beiden Seiten verurteilt wurde macht deutlich, dass viele Gemüter dennoch erhitzt sind. Wasser ist ein Allgemeingut, doch es stellt sich die Frage ob die gesetzlichen Regelungen zur Verteilung von Nutzungsgenehmigungen ausreichen, um die Wasserwirtschaft im 21. Jahrhundert zukunftsfähig zu organisieren. Kann ein Dialog zwischen den Konfliktparteien hier noch zu Lösungen beitragen?

Los Derechos de los Pueblos Indígenas de América Latina en el Sistema de las Naciones Unidas con especial Consideración de la Defensa de la Amazonía (FSL) (Seminar)

Inhalt: El presente seminario transdisciplinario tiene el objetivo de introducir la problemática de la situación de los Pueblos Indígenas (PPII) de América Latina - desde la así llamada conquista hasta la actualidad desde un punto de vista socioeconómico, jurídico, antropológico y ético considerando especialmente la situación y los derechos de las mujeres, niñas y niños indígenas. Un foco especial de este semestre será el estudio de la actual situación de la Amazonía, las amenazas y desafíos actuales. Por lo tanto, se dedicarán las/los estudiantes a estudiar la diversidad de realidades y filosofías de vida indígena, analizarán y discutirán diferentes enfoques y discursos académicos sociopolíticos correspondientes, como ser, el concepto del buen (con)vivir, las teorías del indigenismo y la del indianismo, del constructivismo social, de la decolonialidad, del extractivismo progresista, la teoría de la interseccionalidad, etc. En el seminario se presentarán y debatirán diferentes problemas normativos en el ámbito de instrumentos y políticas nacionales, supranacionales e internacionales con respecto a los Pueblos Indígenas. El organismo de las Naciones Unidas (ONU) llamado “Mecanismo de Expertos sobre los Derechos de los Pueblos Indígenas (MEDPI)” servirá como ejemplo para analizar la problemática de la situación legal y jurídica de los Pueblos Indígenas en el sistema de las Naciones Unidas. Las/los participantes del seminario tendrán la oportunidad de esbozar planteamientos propios para los diferentes puntos de la agenda de la próxima sesión del MEDPI que se llevará a cabo del 4 al 8 de Julio 2022 en Ginebra si la pandemia lo permite.

Inhalt: Ozeane sind global gestaltete Wissensräume – ob als Ort der Imagination sozialer Utopien und wissenschaftlicher Entdeckungen, oder in Form von Projekten zur Planung von künstlichen Inseln, Ölplattformen, Unterwasserkabeln und schwimmenden Serverfarmen. Heute, im Zeitalter von Big Data, Klimawandel und Sea Watch, erzeugen neuartige Überwachungs-, Visualisierungs- und Simulationsverfahren eine veränderte politische Dimension in Bezug auf das Ozeanische – zum Beispiel bei Menschenrechtsverletzungen und Umweltverschmutzung. Neue Technologien z.B. zur Erkundung der Tiefsee erweitern das Spektrum naturwissenschaftlichen Wissens – etwa in Bezug auf Evolutionsbiologie und Medizin. Und zugleich diskutieren auch geisteswissenschaftliche Forschungen – etwas als ›Blue Humanities‹ – die Potenziale ozeanischer Pespektiven. Diese Veranstaltung verbindet eine Diskussion von Medien- und Raumtheorien der Ozeanographie mit einer projektbasierten Untersuchung aktueller diskursiver und technologischer Hinwendungen zu den Ozeanen, um kritische Perspektiven auf die Interaktion zwischen Medien, Architektur, Ökologie und dem Ozeanischen zu gewinnen.

Neue (digitale) Formen der Kunst- und Kulturkritik (Modul 2, Profil Dekri) (Seminar)

Inhalt: Im Kunstfeld hat die Kritik ihren Ort traditionell in der Zeitschrift und der Zeitung. Mit der Digitalisierung konstituiert sich spätestens im 21. Jahrhundert eine neue Vielheit an Möglichkeiten der Verhandlung von Kunst, die auch die Debattenkulturen und die Praxis der Kritik verändern. Vor allem soziale Netzwerke wie Instagram aber auch neue Kommunikationsformen an Museen stellen modifizierte Verfahren für die Auseinandersetzung mit ästhetischen Objekten bereit, denen nachgespürt wird und die anhand von exemplarischen Beispielen diskutiert werden. Zudem wird es eine Exkursion in das Deutsche Hygiene-Museum in Dresden geben.

Inhalt: New Work – Einführung in die New Work und Konsequenzen für Selbstmanagement und Personalführung Entwicklungen und aktuelle Ausprägungen des New Work werden aufgezeigt und anhand von Schlüsseltexten aus verschiedenen Wissenschaftsdisziplinen kritisch-konstruktiv diskutiert und reflektiert. Darauf aufbauend werden die Chancen und auch möglichen Risiken und Hindernisse, die die Entwicklungen im Bereich des New Work für jeden Einzelnen, für Organisationen und auch für Gesellschaften eröffnen, reflektiert. Zugleich wird aufgezeigt, welche Herausforderungen für die die Führung von Menschen damit verbunden sind. Flexibilität und perspektivische Vielfalt im Denken und Handeln sowie die Bereitschaft zu Reflexion und Selbstentwicklung sind dabei unverzichtbare Kernkompetenzen. Veränderung und Entwicklung bedingen einander. Die Entfaltung individueller Potenziale ist entscheidend für die Bewältigung dieser Prozesse. Inhalt: Digital media, digital technologies and digital infrastructures shape contemporary culture in many and far-reaching ways. This seminar examines their impact on 'queer' culture in particular – understood here as both LGBT (i.e. lesbian, gay, bisexual and transgender) cultures as well as, more broadly, cultures that contest or subvert dominant norms around gender and sexuality. Students will explore recent efforts to theorise the relationship between transformations in information, digital and other technologies, and transformations in the fields of gender and sexuality. They will examine recent empirical as well as theoretically-informed work on the ways that digital media and technologies are shaping queer life and culture. And they will address the extent to which the study of digital cultures can be productively approached from a queer perspective. Issues that will be explored include the following: • The role of digital media in transgender self-representation • How social media hashtags (like #lesbian) can facilitate both the production of community and the (de-)stabilisation of identity categories • How LGBT and queer intimacies are being transformed through dating and ‘hook-up’ apps (such as Tinder and Grindr) • The possibilities and limits of digital queer activism • What it means not only to study LGBT gamers, game creators, and game content, but also to study video games queerly • LGBT and queer cultural producers who engage extensively with digital cultures, such as Lil Nas X

Inhalt: Groups affected by racism, homophobia, mysogyny and other forms of exclusion and degradation differ from each other in many aspects. Often these differences are presented as hardly or not at all reconcilable or the respective conditions are scaled against each other. As a result, the respective interests compete for attention, recognition and resources. In the seminar we will deal with approaches that critically confront such a development and ask about the possibilities and conditions of alliances or solidarities between groups. Texts on concepts such as solidarity, post-migrant alliances, the historical "rainbow coalition" or the intersectionality approach form the basis of the discussion.

TASS - Transatlantic Sustainability Seminar (FSL) (Seminar)

Inhalt: Part 1: The seminar starts with students working on the different themes of Int. & EU law & politics. The topics for the assignments should cover environmental and energy issues and should give insight in either legal, economic, social, technical or cultural problems of the exploitation and the use of energy. A topic can be, for instance, the impacts on the environment, especially on ground water, deriving from Fracking. Part 2: The Leuphana students take part in the Leuphana summer school for American students in the second half of May, 2022. This program has been offered since the beginning of the 90ies, teaching American students international aspects combined with intercultural issues in an international environment in order to prepare young adults for a job in a globalized world. It comprises hard facts from fields such as economics, legal, or management, but also soft skills like intercultural communication or business negotiations. By accompanying and maybe even hosting American students, Leuphana students will learn about their background and get ideas for their presentations. Part 3: If possible, an excursion to Brussels will be offered, with insights in EU organization, law & institutions. Students will have to cover their expenses, mainly consisting of travel costs and the necessary spending on food etc.

Think Global, Act Local: Shifting Discourses of Global Environmental Politics (FSL) (Seminar)

Inhalt: It is increasingly recognized that we live in an era of unprecedented and accelerated human-induced global environmental change. How we understand the relationship between society and the environment and has shifted dramatically over the past seventy years. Similarly, our understanding of how local processes are connected to global phenomena has changed over a few decades. This seminar will interrogate shifting discourses of the environment and global development and their influence on global politics, from the limits to growth and human population increases, to sustainable development and global warming, environmental justice and contemporary discourses on the Anthropocene and planetary boundaries. The seminar takes a critical interdisciplinary perspective, examining the role of the natural and social sciences in promoting particular views of the world and humanity’s relationship with the environment. The seminar will furthermore examine the actual and potential role of current efforts to develop integrated, inter- and multidisciplinary perspectives on social-ecological transformation, encompassing the social sciences and humanities as well as a broad spectrum of natural science disciplines.

Thinking sustainability from a Latin American perspective: realities, discourses and challenges (FSL) (Seminar)

Inhalt: IMPORTANT UPDATE: The course is officially held in English. Although sustainability is a worldwide topic, its meaning and implications vary in other realities and contexts, such as the Latin American scenario. In this sense, Western countries' top-down sustainability discourses and approaches to tackle wicked sustainability problems do not fit the challenges Latin American countries face. From understanding the consequences of the colonization process, this seminar will offer an overall picture of the most pressing sustainability topics in Latin America and introduce the students to another way of thinking about sustainability, drawing on Latin American cosmovisions and the signification of the environment and nature. Trapped in Progress? The 'Progress Trap' Concept and Its Significance to Understanding the Situation of Our Globalized Industrial Society (FSL) (Seminar)

Inhalt: The term “progress” has a rather positive connotation. Usually it is associated with improvement or movement towards a set goal. In a materialistic sense, progress stands for technological development and rising living standards. But can this specific type of progress turn into a problem for society? If yes, under which circumstances and to which effect? The seminar deals with these questions by examining the ideological background of the modern understanding of progress, by investigating its technological and economic dimensions and – last but not least – by uncovering possible negative consequences of progress for people and the environment. Special attention will be paid to the "ecological progress trap” concept which will be reconstructed by means of a comparative analysis of historical examples and discussed with regard to its value for the explanation of social and economic developments. The last part of the seminar is dedicated to the applicability of the progress trap concept to the analysis of sustainability issues in today’s globalized society. The discussion will focus on both, the general transferability of the investigated historical “lessons” as well as the theoretical and empirical foundations of the progress criticism which arose out of the corresponding debate.
