In her guest lecture "Shifting Corporate Conscience: From Voluntary to Mandatory Due Diligence" at Leuphana University Lüneburg (at both the Research Consortium on Sustainability Governance of Global Value Chains and the Joachim Herz Doctoral School of Law), Trisha Cruz’ talk takes a closer look at instances which buttress the inefficacy of voluntary due diligence measures. Its aim is to re-establish the necessity ofmandatory due diligence measures such as the CSDDD and other similar mandatory rules via analyzing (the inefficacy of) existing voluntary due diligence mechanisms.To do this, Trisha evaluates evidence fromrelevant studies, jurisprudence and OECD case law forthe past twenty years.
Trisha Cruz is a PhD student at the Department of Private, Business and Labour Law at Tilburg Law School (TLS). She is a foreign qualified lawyer with 10 years of experience. Prior to joining TLS, she was a partner in a law firm in Manila where she headed the litigation and dispute resolution department. She received her LL.M. and M.A. from the EMLE (European Master in Law and Economics) programme of the University of Vienna and the Erasmus University Rotterdam, and her Juris Doctor (J.D.) from the Ateneo de Manila School of Law.
